courtroom. and the search continues for seven missing bay area fishermen. the pressure being placed on mexican authorities as the morning news continues. well, good morning to you. welcome to thursday july 7th. i'm dave clark. >> good morning. i'm pam cook. thank you for joining us. let's check in with steve paulson for a little forecast. hey, steven. all right, pam and dave, thank you very much. we have a lot of low clouds. it will be a much cooler pattern today even inland areas looks like they'll settle into the 80s for some very toasty, concord, fairfield. held onto a couple low 8 0z. i think most locations come down 60s and 70s a lot of fog coast and bay. steve, right now traffic is moving along pretty well on 680 if you're heading south with no major issues. 880's getting thicker though. morning commute's also going to be okay so far in the south bay. 6:01 back to the desk. well, this morning park police are looking for suspects

in a shooting on a popular east bay hiking trail. it happened last night in pittsburg. ktvu's christian captain joins us now to tell us that the shooting is the latest in a string of violence on this trail. christian. >> reporter: yeah. we've moved in just the last half hour to the trail here from the pittsburg police department. you can see that the area is still taped off and you can see a couple of east bay regional park police cruisers and a pickup truck out here. all of this still going on nine and a half hours after that shooting. investigators are still looking for the shooter in this case. now ktvu has been talking with pittsburg police overnight getting details about this case. investigators tell ktvu that emergency crews responded to the delta running trail about 8:45 last night. now those crews found a man lying on the trail with a gunshot wound. firefighters performed cpr and stabilized the victim enough to take him to an area hospital. no word on his condition at this point but we are hearing

that the victim was possibly shot in the head. this is the latest attack in a string of violence along the trail. in may a man was shot along the trail and in june a woman was assaulted. and when a good samaritan tried to come to her aid that person was assaulted too. so coming back out to our live shot you can see investigators are still active out here. pittsburg police were the first to respond. but now east bay regional park police are heading up the investigation in this case. we are hearing that a detective from the east bay regional parks will be here a little later on this morning to pick up this investigation. for now we are live in pittsburg, christian captain, ktvu channel 2 news. time now 6:03. dozens of homes in the east bay city of lafayette still have no water. a water main broke last night at the intersection of mt. diablo boulevard and village center. ktvu's tara moriarty's been out there all morning. she's back now. people waking up with no water, tara, what's the latest? >> reporter: about 100 people

are without water and they haven't had any water for the past eight hours. that's because of a pipe that burst behind me here. they think it's located right underneath that section where the guy is jackhammering. it's located right under that portion of the sidewalk next to that big hole. east bay mud says that that hole was actually created when water burst through the ground. now crews tell us here that this is an eight inch cast iron pipe that ruptured and they will be removing that section of damaged line and replacing it so they can turn the water back on. the water flooded a nearby house last night and the homeowner had just moved here from seattle. all of his moving boxes are now water logged. >> fire department was helpful. we built a makeshift barrier in the back to try to keep the water from coming in the back door from the garage. >> reporter: workers to not have a time line on when the pipe will be fixed. they're currently pumping water out right now. once they get a look at that pipe they'll have a better idea of exactly what they are dealing with.

again, this section mt. diablo boulevard and village center drive. this is all blocked off here. we have one lane in each stretch of the roadway here that's blocked off. don't know how long that's going to be that way but we'll of course be here all morning, monitor it for you and let you know if it effects traffic in anyway. and it's pretty loud out here. back to you guys. right now happening casey anthony is in court for her sentencing hearing which just began. we understand the judge, there he is, he's walked into the courtroom. let's listen in for a moment. >> both sides ready to proceed? >> yes, sir. >> i believe so, your honor. >> mr. mason, before we proceed to sentencing, mr. bias you asked me to reserve ruling on your motion for mistrial. okay. that takes care of that.

the defendant, casey anthony, is before the court for sentencing on counts four, five and six providing false information to a law enforcement officer. mr. biaz do you know of any legal cause why we should not proceed to sentencing at this time, sir? >> four, five, six and seven your honor. >> and seven. >> only legal cause that we have would be previously filed motions. [ indiscernible ] no legal cause why you can't proceed to sentencing. >> would the state care at this time to present any matters relative to aggravation? >> not on that issue, your honor, no. >> state care to present any issues at this time concerning

any other matter? >> your honor, yesterday i filed a motion to tack special investigation and prosecution and to reserve jurisdiction. the only reason i would bring this up prior to the actual sentencing has to do with the jurisdiction of the court once sentence is imposed if defense counsel intends to appeal the misdemeanor this court would not be able to entertain a later hearing until that matter is resolved as it relates to costs of investigation. if in fact that is their intent, what we would ask is that the court by from kate the sentencing hearing proceeding to the matters of punishment first the issue of cost of

investigation is not intended to be punitive and i believe can be handled at a later point in time in a bifrom kateed type of proceeding that would handle this matter so that this can be closed as expeditiously as possible. that is the only thing i wanted to bring up at this time. >> mr. biaz. >> mr. mason will be handling. >> mr. mason? >> i do not object to the process your honor. they have not presentedin voices to us any accounting as of yet which we will be reviewing and then challenging as appropriate. she asked for 60 days. i have no problem with that. >> okay. the court will retain jurisdiction to deal with the issue of cost of prosecution and other costs i guess

to counts five, six and seven because all four statements in the indictment arose during the july 16th interview between detective and miss anthony all four counts of providing false information to a law enforcement officer were one continuous act with a single intent. as such each false statement separately charged violates double jeopardy and must be reduced to one conviction based on one occurrence and course of conduct. state which we provided to the court that's 934 southern second 634 that's a florida second d.c.a. case from 2006. the defendant was convicted of 15 counts of using a computer to seduce a child. at issue was whether counts five and six among other things arose from a single criminal episode. and ham mill the court articulated the test to considering whether offense orrises from a single criminal episode. in that test the court articulated -- >> let me stop you for a

second. >> yes, your honor. >> i don't seem soft benefit of what you said you provided the court. >> i apologize, your honor. i gave that to the clerk and i should have instructed that you needed to have that. >> okay. okay. go ahead. >> thank you, your honor. this test requires the court to look to whether there was a separation of time, place or circumstances between the crimes because those factors are objective criteria utilized to determine whether there are distinct and independent criminal acts or whether there is one continuous criminal act with a single criminal intent. court went onto say that the spatial and temporal aspects of the crime looking at that criteria a court can ascertain whether the defendant had time to pause, reflect and form a new criminal intent between the occurrences. your honor, in finding that counts five and six in the ham ill case were a violation of

double jeopardy, the court pointed to the fact that there was no temporal break in the conversation or change in circumstances to warrant separate charges where the conversation in question spans several hours. similarly, your honor, the false statements miss anthony made to detective malicho curred during the course of a single interview on july 16, 2008. the interview was one continuous conversation and similarly no temporal breaks or other criteria that would suggest the defendant had time to pause, reflect and form a new criminal intent as required so as to not run a foul of double jeopardy -- >> all right. we are watching live the court pridings this morning in orlando, florida. the sentencing hearing for casey anthony. and right now there's a member of her defense team presenting to the judge both sides are presenting a few issues before the sentencing is read and they're talking about double

jeopardy and perhaps further cases down the road the prosecution mentioning what sounded like a couple of the lawsuits we've been talking about. one of them being they may go after casey anthony for the cost of the investigation and the prosecution of this case. so, again, we're going to dip back in as soon as we start hearing the judge talking about the actual sentencing. but right now we want to come back here and check in with steve and sal onwetter and traffic. are we starting with sal in traffic? what's going on, sal? things are getting busier out there in case you're trying to get through the contra costa commute we're going to start there this morning on 80 westbound coming out to the contra -- western contra costa county. that traffic is getting busier although it's not stop and go from the bridge to richmond. and if you're on highway 4 westbound highway 4 traffic is also pretty busy because of that crash at g street. livermore valley 580 little bit of slowing in the halt month pass but from livermore to

castro valley looks good and no issues on 880 and 238 area. san mateo bridge westbound 892 looking good. so does the bay bridge. we have a live picture of that. traffic still has not filled in. metering lights are not yet on. 6:13 let's go to steve. thank you, sal. a lot more fog today. in fact it's moving locally over the bay. it was struggling last couple days as high pressure just wouldn't allow it. it was there but very shallow. that's not the case now. it's filled in big time. few high clouds could rotate around coming up from the san bernardino area, riverside had some pretty good thunderstorm activity yesterday. most will move off towards the east as we get more of a southwesterly direction not only at the surface but also the upper atmosphere. 58 concord. dipping near below 60. sure sign of cooler pattern. santa rosa at 50 sonoma county airport low 50s napa, san rafael, san francisco. low clouds temperatures probably won't cool off much more. calm conditions or a west- southwest 16 even a west- southwest at vacaville. that's a delta breeze.

once that's in place then things will start to cool down inland. they started yesterday even though we still had some 90s but the system in the pacific northwest it's looking pretty strong and it's going to settle in and then another one will move in behind that sunday, monday to keep the pattern going which is cooler. low clouds, sunny, breezy, delta breeze cooler inland temperature 60s, 70s coast and bay. 68 sausalito. 88 st. helena. fairfield 8. 88 concord. danville san ramon held onto a couple very low 890s but there will be a sea breeze. 72 san leandro. 67 alameda. 79 fremont, 88 morgan hill. but temperatures with a northwest direction for the santa clara valley come down as well. 60s 70s on the peninsula. one very low 80s. more fog, cooler on friday and then a pattern that will settle on 80s inland, 60s, 70s coast and bay. time now 6:15. some of the bay area men who survived that fishing boat disaster of mexico may be heading home this morning. show you video from the mexican

navy just moments after the men were rescued late sunday. the survivors were so exhausted smooch them had to be picked up and carried and then placed into a helicopter. 35 tourists and crew members were thrown off that boat when it sank in a violent storm sunday. they were in the water 16 hours clinging to water coolers and life vests before they were rescued. well, seven fishermen from northern california are still listed as missing this morning. they are awaiting news about the fate of their husbands. the fishing trip to sanify leap was a first for gene an avid fishermen. his family says he's very safety conscious and planned to sleep in his life vest if the weather was bad. >> good swimmer, boy scout. he's a survivor. he's tough. i know he's out there somewhere. >> the family members have been working the phones, e-mails, social networks even asking

politicians to pressure the mexican government to keep up the search. and state senator yee says the mexican authorities told him the search would extend beyond 96 hours. happening now. we want to take you back to the orlando courtroom. we've been hearing from both sides. prosecution and the defense. let's listen into the judge now. >> count seven, your honor, this is the same interview we've been discussing to detective mulch. and this allegation is based on miss anthony asserting that she received a phone call from caylee marie anthony. >> okay. just a second. since you just provided these cases to me. >> yes, sir. >> let me read them right quick to see if i have any additional questions. >> yes, sir. >> before i hear from the state

of florida. all right. again, we've been back and forth to orlando, florida, watching the casey anthony sentencing this morning. we're still looking in live. these are live pictures where we're following this and waiting for new developments to happen. now we told you the casey anthony is in the courtroom for this hearing. and we're waiting just for latest developments to see what the judge will decide as to what will happen and the punishment for casey anthony. >> we understand her parents are also in the courtroom and that there are some protesters outside. certainly a lot of people were not happy about the verdict. and they're waiting to see about the sentencing. but we've been talking about it this morning. in all likelihood she could be released today. >> could possibly. >> because she has four counts of lying to police officers, giving false information and maximum of four years i believe sentencing and she already could be credited with the three years time served during

the trial. so that is a speculation that she could be released. but the other speculation is that the judge might have some interesting comments about what he thinks about the case. we haven't really gotten to hear from him. but now the sentencing phase is where you might hear something from the judge. >> questions are being raised about possibly making casey anthony pay some of the court costs for this trial to this point. you see her conferring with her attorney right there. there's also concerns about security around the courtroom. there have been reports of sheriff's deputies with gas masks in place for any possible response to whatever happens in court this morning. >> it's interesting the judge right now is reviewing some paper work presented to him. and it's regarding double jeopardy. they've been bringing up a lot of talking a lot of legal talk but basically sounding like they're presenting a case to make sure that this will end

this case today. >> for each one of those four separate acts. all right. again, we're listening in to orlando, florida, live in the courtroom. we're going to dip back in. we're monitoring this in the newsroom because we're certainly waiting mostly to hear from the judge and the sentencing of casey anthony. so stay with us. we're going to dip back in with that in a little bit. all right. our time is now 6:20. in other news this morning police in las vegas searching for a gunman responsible for a shooting that happened outside of a funeral home. investigators say the man wounded seven people before racing away in a car last night. all seven victims are expected to survive. the witnesses say that shooter was mixing with the mourners before suddenly pulling out a gun and started shooting. still no word of a motive here. the funeral was for a young man

who was stabbed to death on the vegas strip last month. time now 6:20. let's go back over to sal to check in on bay area traffic this morning. sal. right now traffic is doing pretty well around the bay. but we do have some things to watch out for. let's go and take a look at the san mateo bridge westbound 92. that traffic is doing okay getting out to highway 101. also this morning if you're driving to the bay bridge toll plaza it is not a bad drive there. it's light at the toll plaza. livermore valley 580 westbound still getting a little bit busier coming into the livermore part but after that dublin and castro valley looks good. 6:21 let's go to steve. sal, thank you, sir. a lot bigger fog bank today and it's lifted a little bit. last couple days it was way down there on the deck. it's not only doing that it's coming over the bay. that's a sign that high pressure system is losing its grip. it's hard to move. it's a big guy. some tropical clouds may also filter in there. down just off monterey.

so some of those may move in to say southern part of peninsula, santa clara valley east bay. most should dissipate. 50s low, mid and upper to some 60s. 65 fairfield. they have a pretty good sea breeze and system is moving into the pacific northwest. it's going to mean even conditional cooling will take place for inland areas. might take another day for some lake county or inland. delta breeze is there. 60s to low 90s. i think after today we can say good-bye to the 90s unless you're way out there. and there will be a lot of 80s. the parking lot earn shows cooler pattern friday and then sits there for the next five or seven days for subtle changes. pam and dave. thank you, steve. it is 6:22. again, we are live inside the courtroom in orlando, florida waiting for the judge to hand could be the sentence for casey anthony. stay with us. we'll be right back.

hearing is underway for florida mother casey anthony. now she was acquitted on charges of -- involved in the death of her daughter, caylee. but she is being sentenced for counts of lying to police officers during the investigation. legal experts say she could be sentenced to time already served. she could walk out a free woman today. there are her parents inside the courtroom. protesters outside. we are watching. we'll bring you the sentence as soon as that happens. all right. our time is 6:26. back here at home cal fire losing a very important fire fighting tool just as the fire season gets underway. they will be no longer have the use of this the dc10 one of the nation's largest fire fighting jets. the state just canceled its contract with the company that rents out that super tanker because of budget cut backs. these jets can carry up to 12,000 gallons of fire retardant. most recently it was sent to help out with the arizona wild

fires. tonight solano county's planning commission plans to approve a new wind farm project, but the idea is raising concerns. a sacramento based nonprofit group says the project could hurt local birds including some that are protected. now they say the latest environmental report shows two hawks were killed by wind turbines in the area. consultants with the project say they plan to provide safe habitats for the birds. time now 6:26. a group of scientists in the united kingdom say they found a way to recycle all types of plastic. right now only certain types of plastic is recyclable. but using a technique that applies heat in the absence of oxygen, well, these scientists were able to break down plastic to its basic elements. they say this could mean a significant reduction in plastic pollution. in 2009 only about 7% of plastic trash was recyclable. we cardiologist to follow the sentencing of casey anthony. we are live inside the

fact that she had informed two "employees of universal studios, jeff hopkins and juliet lewis" of the disappearance of caylee marie anthony. count seven indicated to law enforcement that she had received a call and spoke to caylee marie anthony on july 15, 2008, at approximately 12:00 p.m. thus causing law enforcement to devote extensive resources. as a result of those four separate and distinct lies, law

enforcement expended a great deal of time, energy and manpower looking for young caylee marie anthony. this search for her went on from july through december over several months trying to find caylee marie anthony. four distinct separate lies just as the jury spoke loud and clear. >> all right. we're listening live to the judge in the casey anthony trial. the sentencing hearing going on right now. he's talking about and he's mentioned it more than once

four separate distinct times that casey anthony lied to police officers caused a lot of time and resources and money for the police department and the investigation looking for casey anthony -- caylee anthony when she was in fact not missing but dead. so we're going to continue to monitor this and we're waiting for the sentencing. we'll come right back to o orlando when we hear that that judge is going to sentence casey anthony. all right, pam. time now 6:33. here at home a man is fighting for his life this morning after a shooting at a popular east bay hiking trail. ktvu's christian captain tells us this happened last night on the delta regional trail in pittsburg. good morning, christian. >> reporter: good morning, dave. there's still a lot of activity out here at that trail. take a look you can still see the scene taped off. east bay regional park police truck and in the distance there there's also a cruiser. so there's still obviously heavy police presence out here. investigators still looking for

become available to us. for now we're live in pittsburg, christian captain, ktvu channel 2 news. there is new information this morning from a witness of sunday night's deadly bart police shooting. it comes as police say they plan to release surveillance video from the scene. she says she saw the whole incident unfold at the civic center station. she says the man was walking towards police but not in a threatening manner. she also says they should have tasered him instead of using their guns. but bart police say the man was aggressive and armed with a bottle and a knife. they expect to release surveillance video once all of the witnesses have been questioned and if the san francisco district attorney allows it. time now 6:35. right now about 100 people have no water in lafayette. started when a water main broke about 10:30 last night at the intersection of mt. diablo boulevard and village center. the water quickly ran down the

streets towards homes and office buildings. one man says he was up working late when he saw the reflection of water in his backyard. >> i threw my shoes on and went to run and looked out the sliding glass door and the backyard was probably five inches deep of water. >> now the crews are on the scene they're trying to fix that water main. right now they don't know when the water will be turned back on. well, the only remaining active space shuttle is set to start fueling in just a couple of hours, but the whole mission may be delayed. the last mission could be delayed by bad weather in florida. our reporter jim spellman is live at kennedy space center right now with the very latest on the weather forecast and when atlantis may liftoff, if that launch is scrubbed. good morning, jim. >> reporter: yeah, good morning to you, dave. we're only hearing, dave, that about 30% chance that this atlantis will be able to take off on time tomorrow morning scheduled for 11:46 eastern time but the weather's just not

looking good. we've already had a few sprinkles today. they can't make that ten minute launch window they'll try again saturday. if that doesn't work they have to do some refueling procedures and they'll try again monday. they want to be sure of course everything is safe and optimal conditions when they takeoff. this final atlantis mission here is really going to be significant for everybody at nasa and in this community. they're going to be up there for 13 days, four person crew going to visit the international space station for the final time with the shuttle drop off some supplies there. do a few experiments. it's really such an end of an era here that i think until this -- when it's over i think we're all going to really feel the impact that americans won't actively going to space on nasa spacecrafts for the near future, dave. >> all right. jim spellman reporting live from the kennedy space center. thank you for the update. all right. we have an update on the casey anthony sentencing as well. happening right now we're back live in orlando. the judge has sentenced casey

anthony to four years for lying to investigators in the death of her daughter. four years was the maximum. attorneys asking for credit for time already served. she's served three. so but the judge is saying that casey anthony will not be released today, but could be released from jail in late july or early august. so, again, we've been listening in live the sentencing of casey anthony sentenced to four years for lying to investigators and could be released from jail late july, early august. we know her parents are inside the courtroom. and there are protesters outside. there are a lot of people who are angry. her defense attorney has said he worries about her when she gets out. but, again, that's the update on that breaking news. we're going to check back. we'll have more on mornings on 2 all of the details of what happened in the court today. stay tuned. we will have it all for you. you won't miss a thing. >> we're going to have a live report from orlando as

welcoming up. that's right. time now 6:38. we also have sal live looking at our commute. how's that looking? we have a problem in san francisco stalled double wide motor home trying to make its way on to the bay bridge it became stalled eastbound 80 before seventh. it was a tractor-trailer. this big rig pulling a double wide modular office. i wasn't a home it was an office trailer. now blocking the two right lanes. so the trailer has slipped off the frame. traffic is backing up onto highway 101. it is awful there northbound 101 is now backing up to highway 280. and then 280 is slow coming on down to the albany maze. this is a major problem in san francisco if you're trying to get to the lower deck. if you live in san francisco and work in oakland, get out of the house early. we might even call some of the people who work here at ktvu and say, hey, guess what, you're going to have a terrible commute. that's what's going on. westbound is not all that bad. let's move along and take a look at westbound traffic is backed up from the middle of

the parking lot. and this morning's drive is okay on the san mateo bridge. if you work in the east bay and don't have to use the bridge why not try the san mateo bridge eastbound looks good getting out to hayward right now. let's go to steve. sal, thank you. we have some breaks in the low clouds but bigger fog bank today. just poked my head out the back door and it's overcast. haven't seen that in a couple days. a lot of low clouds. few reports clear breaks in the clouds but it's fog, sun, breezy pattern. cooler pattern as well as this begins to move into the pacific northwest. coast low 6 0z mostly cloudy. a lot of low clouds, fog, around the bay fog then breezy 60s and 70s. warm inland but not the hot hot anymore. upper 80s and low 9 0z. fog bank has thickened up and there it is right there. last couple of days it was way down there. it's now lifting as the high pressure system which has been dominating our weather and producing a lot of tropical clouds along the spine of the sierra and also down to san bernardino county.

some of that blow off is what we call it when the thunderstorms collapse. some of those high clouds may drift up from the south. 50s and 60s cool santa rosa, 52 san rafael, san francisco napa 53. 54 oakland. 50s for some or low 60s but a little cooler than we've seen the last couple mornings. and there's a no doubt about it delta breeze from fairfield to vacaville. so once that's in place that all equals cooler. you can see the system digging in right there. as that moves in it's going to park at the high pressure system. in fact the ten day outlook puts it right in the middle of the country away from us it will be hot, hot. real hot in the middle of the country. for us cooler pattern looks like it's going to hang out for a while. very foggy on the golden gate bridge. the high is getting bumped out of here and the cooling trend that started yesterday really starts to move in today because the fog is going to win out. low clouds, sunny, breezy, delta breeze. for those well inland might have to wait another day. cool down as we head into the weekend. 60s 70s 80s and 90s. clear lake always one of the last to cool off.

released from prison later this month or early next month. casey anthony was acquitted in the death of her 2-year-old daughter caylee. back here at home a man is fighting for his life this morning after a shooting at a popular east bay hiking trail. it happened last night on the delta regional trail in pittsburg. it was a third violent incident at that park in the past three months. and we're looking live. this is lafayette in the east bay. live pictures there from mt. diablo boulevard in lafayette. crews are working to fix a big water main break there and about 100 customers have no water this morning. a british tabloid is under fire following reports that it hacked into the personal cell phones of celebrities and crime victims. people protested against the paper, news of the world, outside the british parliament. that's after reports surfaced that the tabloid hacked into the cell phone accounts of murder victims, celebrities and

we've been talking about it as you know eastbound 80 at seventh there's a stalled truck that was carrying a double wide modular office. it's almost like a double wide mobile home, but it's just an office. it's a square building. one of those double wide trucks that you see sometimes, well, the building slipped off the trailer's frame. this is a big problem for san francisco. northbound 101 is effected of course. so is drive to the bay bridge. now if you are trying to get on to the lower deck of the bay bridge if you live in san francisco trying to get to the east bay, the best way to get on to the bay bridge would be to get on the bridge after seventh. that would be go to fulsome and get on at first or get on down there near the embarcadero as you come up to the first street area. avoid getting on before seventh. so avoid getting on 101 basically. this traffic problem is going to be there for a while. let's go out and take a look at san mateo bridge. you also may want to use the

san mateo bridge eastbound to get over to the east bay instead. if you are driving on 237 we have some stop and go traffic already crossing 880. now let's go to steve. sal, thank you. a lot more fog and low clouds, but we do have plenty of breaks in the fog. there's a big old fog bank out there and it's been getting thicker and thicker each day and it's also lifting a little bit. inland areas even though they'll be sunny and warm it will not be as warm as the last couple days. that's for sure. 49 to 60 on some of the lows. santa rosa down to 50 briefly. low clouds, fog, sunny though for some already. fog, sun, breezy. the wind will pick up today. 55 to 80 degrees by noon. so, again, i mean we could have another big spread on these temps. instead of the 40-degree spread maybe more of a 30. cool to warm but there will be a sea breeze kicking in. it's already there for the delta that hasn't been the case the past couple days. fog not only is it lifted it's starting to make a bit stronger push. so breezy, low clouds, fog, westerly breeze. 60s still a few low 90s holding

on. cool to warm, maybe a few high clouds coming up from southern california. the remains of some thunderstorms which erupted there yesterday now also along the sierra nevada kind of impressive: now that the upper atmosphere is turning more southwesterly direction it will take all that moisture away from us as the high moves off towards the middle of the country low pressure settles into the pacific northwest. that will open the door for natural air-conditioning and i mean it's already starting to show itself. west-southwest at vacaville. if vacaville gets a sea breeze that tells you everything you need to know. system right there off seattle and portland is going to move in and park it over pacific northwest and northern california. the end result will be a cooler pattern for us. it started yesterday for many. it will continue today. might take one more day for areas like clear lake, antioch, brentwood, pleasanton did go low 90s but there will be some 8 0z. 67 alameda. 80 sunny vale. 82 san jose. 8 morgan hill. 70s fremont. a lot of 70s on the peninsula or 60s along the san mateo coast down to santa cruz.

all right. time now 6:53. back to breaking news in the casey anthony sentencing. a judge sentenced her this morning to four years for lying to investigators. but she's getting credit for time served. let's try once again our reporter holly live. good morning, holly. >> reporter: good morning, dave. yes, judge perry handed down the sentence to casey anthony this morning in the 9:00 eastern hour. and basically told her that he was going to give her the maximum one year and $1,000 fine for every misdemeanor charge. she was given four misdemeanor charges. and that is for lying to

investigators during their search for caylee in 2008. now she has served just about three years in prison already. now the sentences will be consecutive meaning one after the other. so she does still have some time to serve. just how much time? we don't know for sure yet. basically now they have to go do the math. they have to figure out exactly how many days she's been in prison and exactly how many days she has left. and then also you get credit for good behavior. we don't know exactly when she will be released from prison, but it won't be today. dave. >> holly, are there any restrictions on her when she does get out? will there be any restrictions on her at all that we're aware of at this point? >> reporter: not at all. because she was not charged with murder she can profit from this incident. she can tell her story. remember casey anthony hasn't spoken in court. she did not testify.

so she could write a book. she could write a screen play for a movie. she could ask people to pay her for interviews. so she stands to make quite a bit of money after this is all said and done. however, the state of florida is asking to be reimbursed for the man hunt for all the man hours and money they spent looking for caylee. and a texas firm who also spent about $112,000 says they may sue her to recoup their money to use it towards people who need to find missing loved ones, dave. >> all right. holly there in orlando, florida. interesting story in the casey anthony sentence. credit for time served, out probably late july, early august. it will be interesting to see what happens outside the courthouse though because we understand there are protesters. we'll hopefully get more on thatment cooing up on mornings on 2. time now 6:56. let's go back to sal and check on our commute. all right. we do have a problem in san francisco eastbound 80 at seventh.
